// LEGAL PROTECTION FOR SERVICE MEMBERS

SCRA COMPLETE GUIDE

The Servicemembers Civil Relief Act is one of the most powerful legal protections available to active duty military. Here's what it covers and how to use it.

What is the SCRA?

The Servicemembers Civil Relief Act (SCRA), originally passed in 1940 as the Soldiers' and Sailors' Civil Relief Act and updated in 2003, is a federal law that provides financial and legal protections to active duty service members. The law recognizes that military service creates unique financial hardships, and provides specific protections to reduce those burdens.

SCRA covers Active Duty Army, Navy, Air Force, Marine Corps, Coast Guard, Space Force, and National Guard/Reserve members when on active duty orders. Coverage begins on the date of active duty entry and ends 30–180 days after release (depending on the protection type).

// KEY SCRA PROTECTIONS

📉

6% Interest Rate Cap

Lenders must reduce the interest rate on any pre-service debt to a maximum of 6% per year while you're on active duty. This applies to:

  • ✓ Mortgages originated before active duty
  • ✓ Auto loans taken before service
  • ✓ Credit card debt accrued before service
  • ✓ Student loans (private — federal loans have separate protections)
  • ✓ Personal loans originated before service
How to activate: Send a written request to each lender with a copy of your military orders. The lender must reduce the rate within 180 days. The reduction is retroactive to the start of active duty.
🏠

Lease Termination Rights

You can terminate any residential lease with only 30 days written notice in these situations:

  • ✓ PCS orders to a location 35+ miles from your current residence
  • ✓ Deployment orders of 90+ days
  • ✓ Release from active duty
Effective date: Termination is effective 30 days after your next rental due date. Landlord cannot charge early termination penalties or withhold security deposit for SCRA terminations.
🛡️

Eviction & Foreclosure Protection

SCRA provides protections against eviction and foreclosure proceedings:

  • ✓ Landlords cannot evict you (or your dependents) without a court order during active duty if monthly rent is below $4,178.56 (2024 limit, adjusted annually)
  • ✓ Courts must postpone eviction proceedings if you request a stay due to military service
  • ✓ Mortgage foreclosure requires court order and 90-day notice during active duty
  • ✓ Foreclosure protections continue 12 months after active duty ends
⚖️

Protection from Default Judgments

Courts cannot enter a default judgment against a service member in any civil proceeding without first determining whether the defendant is on active duty. If you receive notice of a civil lawsuit while deployed, you can request a 90-day stay in proceedings — and courts must grant it. This protects you from being sued and losing a case simply because you couldn't respond due to deployment.

🚗

Auto Loan & Personal Loan Protections

SCRA covers pre-service vehicle and personal loans:

  • ✓ Interest rate capped at 6% on pre-service auto loans
  • ✓ Vehicle cannot be repossessed without a court order during active duty
  • ✓ Seller cannot keep deposit or accelerate the loan balance during active duty

// CREDIT CARD ANNUAL FEE WAIVERS (SCRA + MLA)

Under SCRA and the Military Lending Act (MLA), most major premium credit cards waive their annual fees entirely for active duty military. This can save $250–$695+ per year per card.

// HOW TO ACTIVATE SCRA BENEFITS — STEP BY STEP

1
Get Your Orders
You need a copy of your active duty orders (accession orders, PCS orders, or deployment orders). This is your primary documentation.
2
Identify All Pre-Service Debts
List every debt you had before your active duty start date: mortgage, car loans, credit cards, student loans, personal loans. You'll contact each lender.
3
Write a Request Letter
Send a written request to each lender stating: your name, account number, that you're requesting SCRA rate reduction, your active duty start date, and attach your orders.
4
Send via Certified Mail

// FREQUENTLY ASKED QUESTIONS

Does SCRA apply to debts I take on after entering active duty?
No. SCRA only covers debts you incurred before your active duty start date. For debts taken after activation, the MLA (Military Lending Act) may apply instead.
How do I prove I'm on active duty to my lender?
Provide a copy of your orders and a written request. The Department of Defense also maintains the SCRA database at servicemembers.defense.gov where lenders can verify status.
Can SCRA reduce my mortgage rate to 6%?
Yes, if the mortgage was originated before your active duty start date. Submit a written request to your mortgage servicer with a copy of your orders. The rate reduction is retroactive to your activation date.
Does SCRA protect my credit score during rate reduction?
Lenders cannot report the difference between what you pay and the original amount as delinquent. Your credit score should not be negatively impacted by invoking SCRA protections.
Can I terminate my apartment lease early under SCRA?
Yes. You can terminate a lease with 30 days written notice after receiving PCS orders or deployment orders of 90+ days. The termination is effective 30 days after your next rent due date.
What if my lender refuses to honor SCRA?
File a complaint with the Consumer Financial Protection Bureau (CFPB) at consumerfinance.gov. You can also contact your installation's JAG office — SCRA violations carry civil penalties.
Does SCRA apply to active duty Guard and Reserve members?
Yes, but only while on active duty orders. The protection applies during the period of activation.
