The Servicemembers Civil Relief Act is one of the most powerful legal protections available to active duty military. Here's what it covers and how to use it.
What is the SCRA?
The Servicemembers Civil Relief Act (SCRA), originally passed in 1940 as the Soldiers' and Sailors' Civil Relief Act and updated in 2003, is a federal law that provides financial and legal protections to active duty service members. The law recognizes that military service creates unique financial hardships, and provides specific protections to reduce those burdens.
SCRA covers Active Duty Army, Navy, Air Force, Marine Corps, Coast Guard, Space Force, and National Guard/Reserve members when on active duty orders. Coverage begins on the date of active duty entry and ends 30–180 days after release (depending on the protection type).

6% Interest Rate Cap
Lenders must reduce the interest rate on any pre-service debt to a maximum of 6% per year while you're on active duty. This applies to:
- ✓ Mortgages originated before active duty
- ✓ Auto loans taken before service
- ✓ Credit card debt accrued before service
- ✓ Student loans (private — federal loans have separate protections)
- ✓ Personal loans originated before service
Lease Termination Rights
You can terminate any residential lease with only 30 days written notice in these situations:
- ✓ PCS orders to a location 35+ miles from your current residence
- ✓ Deployment orders of 90+ days
- ✓ Release from active duty
Eviction & Foreclosure Protection
SCRA provides protections against eviction and foreclosure proceedings:
- ✓ Landlords cannot evict you (or your dependents) without a court order during active duty if monthly rent is below $4,178.56 (2024 limit, adjusted annually)
- ✓ Courts must postpone eviction proceedings if you request a stay due to military service
- ✓ Mortgage foreclosure requires court order and 90-day notice during active duty
- ✓ Foreclosure protections continue 12 months after active duty ends
Protection from Default Judgments
Courts cannot enter a default judgment against a service member in any civil proceeding without first determining whether the defendant is on active duty. If you receive notice of a civil lawsuit while deployed, you can request a 90-day stay in proceedings — and courts must grant it. This protects you from being sued and losing a case simply because you couldn't respond due to deployment.
Auto Loan & Personal Loan Protections
SCRA covers pre-service vehicle and personal loans:

- ✓ Vehicle cannot be repossessed without a court order during active duty
- ✓ Seller cannot keep deposit or accelerate the loan balance during active duty
